2. GENERAL SERVICE PRINCIPLES
- The Markimoc.pl website focuses its activities on the sale of products and services necessary to achieve the objectives of positioning websites
- To use the functions of Markimoc.pl website it is necessary to have a computer, smartphone or other mobile device, which is equipped with a browser supporting JavaScript.
3. PURCHASING/ORDERING
- Purchasing products and services offered on Markimoc.pl does not require registration.
- Realisation of purchase on Markimoc.pl website takes place by adding the product or service to the shopping cart using the “Add to cart” button, and then clicking on the “Buy and pay” button.
- The condition for the realization of the purchase is that the buyer/orderer must provide correct contact details and e-mail address.
- If the Buyer/Orderer of the product or service runs a business, then he/she is required to provide company data and NIP (Tax Identification Number).
- The ability to place orders at Markimoc.pl is available year-round, 24 hours a day, and the deadline for orders is specified in the purchase forms.
- In the event that circumstances arise that temporarily or completely prevent the realization of an order placed, Marki Moc Ümit Değerli company with its registered office in Lodz, Zamojska Street 18a lok. 4, reserves the right to suspend the realization, previously informing the Buyer/Orderer of the circumstances immediately.
- Orders in which the Buyer/Orderer has incorrectly provided contact details (no phone number, inactive e-mail address) will not be considered.
- The prices of products and services offered by BackLink24 are given in PLN (Polish zloty) and include VAT.
- The owner of Markimoc.pl website - Marki Moc Ümit Değerli company issues a VAT invoice for purchased/ordered products and services. The basis for receiving a VAT invoice by the Buyer/Orderer is to provide correct company data and Tax Identification Number in the form.
- The Buyer/Orderer of the product or service shall receive information on the e-mail address provided confirming the order.
4. ADVERTISEMENT AND RESIGNATION PROCEDURE
- The User may file complaints regarding the Services provided on the Site, in particular, their non-performance or improper performance.
- Complaints may be reported in writing, in the form of a registered letter, to the mail address: kontakt@markimoc.pl
- Complaints should include the designation of the person submitting the complaint (name and surname or company name, address of residence or registered office, e-mail address) and a description of the event giving rise to the complaint.
- Claims will be considered within 30 days from the date of their receipt by the Service Provider.
- The Service Provider undertakes to respond to the Client's complaint (notice) within 14 days. Failure of the Service Provider to respond after the expiration of the period indicated in the preceding sentence shall result in the recognition of the complaint as justified.
- The Service Provider shall be liable under the warranty if the defect is discovered before the expiration of 2 years from the release of the Product to the Buyer.
- The Service Provider will inform the Client about the result of the considered complaint in writing in response to the notice via e-mail to the Client's e-mail address provided in the complaint notice.
- If the data or information provided in the complaint needs to be supplemented, the Service Provider will ask the complainant to supplement it in the indicated scope before considering the complaint.
- Within 14 days from the conclusion of the contract (creation of the Account), the Client may withdraw from it without giving any reason. To withdraw from the contract, inform us of your decision by writing to the e-mail address: kontakt@markimoc.pl. The right to withdraw from the contract does not apply if we have fully performed the service with your express consent (if you have made a purchase in the store).
5. PAYMENTS
- The Markimoc.pl website allows Buyers/Orderers to pay via bank transfer and online payment via online payment services przelewy24.pl, paypal.com.
- The Buyer/Orderer of a product or service receives information to the e-mail address provided confirming the payment.
6. PROTECTION OF PERSONAL DATA
- Personal data of Buyers who are natural persons are obtained through the registration form. Purchasers register voluntarily. Personal data will be processed by the Seller as the administrator of personal data in order to provide services by the Seller, as well as for marketing purposes related to the functioning of the Seller's enterprise, including the Store, and concerning services and goods presented in the Store. Processing of the collected data will be carried out in accordance with the provisions of the Act of August 29, 1997 on the protection of personal data and the Act of July 18, 2002 on the provision of electronic services. Provision of personal data by the Purchaser is voluntary.
- Personal data of Buyers may be made available to entities authorized to receive them under applicable laws, including the competent judicial authorities.
- The Seller shall ensure that Purchasers whose personal data it processes exercise their rights under the Personal Data Protection Act, including the right of access to the content of their own personal data and their correction, as well as the right to control the processing of their own personal data on the principles described in the said Act.
- In the exercise of the right to control the processing of one's own personal data, the Purchaser has, in particular, the right to file a written, reasoned request to stop the processing of his data due to his particular situation, as well as to object to the processing of his data when the Seller intends to process it for marketing purposes or to the transfer of the Purchaser's personal data by the Seller to a data controller other than the Seller.
- Confidential information concerning Purchasers, including Purchasers' personal data, is protected by the Seller against its disclosure to unauthorized persons, as well as other cases of its disclosure or loss, and against destruction or unauthorized modification of the indicated data and information through the use of appropriate technical and organizational safeguards. II. Technical interruptions
- The Seller is not responsible for the lack of access to the Store caused by factors beyond the Seller's control and the resulting consequences.
- The Seller reserves the right to interrupt access to the Store due to its technical service, maintenance work or work on improving the functionality of the Store. At the same time, the Seller undertakes to make every effort to ensure that the aforementioned interruptions take place at night and last as short as possible.
7. FINAL PROVISIONS
- The Seller reserves the right to change the provisions of the Terms and Conditions. The change shall become effective upon publication of the amended Terms and Conditions on the Store's website. The change in the Terms and Conditions does not apply to Contracts concluded before the new Terms and Conditions came into force.
- When concluding an Agreement after the amended Regulations come into effect, the Purchaser will be asked to accept the new Regulations. All matters not regulated by these Regulations shall be governed by generally applicable provisions of Polish law, in particular the provisions of the Civil Code, the Personal Data Protection Act, the Act on Electronic Service Provision, as well as the Act on the Protection of Certain Consumer Rights and Liability for Damage Caused by a Dangerous Product. Any disputes between the parties shall be settled by the competent common court.
